Personal data collected as part of the application process
Personal data means any information concerning the personal or material circumstances of an identified or identifiable individual. This includes, for example, your name, address, telephone number and date of birth, but also data relating to your career by reference to which a specific individual can be identified with reasonable effort. Information which cannot be (in)directly associated with your identity is not personal data.
Fundamentals and purposes of processing
If you apply to us electronically, i.e. via e-mail or using our online form, we collect and process your personal data for the purpose of executing the application process and preparing a possible employment relationship. The legal basis is Art. 6 (1) (b) GDPR (pre-contractual measures) and, where applicable, Art. 6 (1) (f) GDPR. Our legitimate interest lies in the efficient organisation and execution of our application process.
By submitting an application via our recruitment website, you express your interest in working with us. In this context, you transmit personal data, which we use and store exclusively for the purpose of your application process.
In particular, the following data is collected:
- Name (first and last name)
- E-mail address
- Phone number
- LinkedIn profile (optional)
- Channel through which you found us
Furthermore, you can choose to upload documents such as a cover letter, your CV and reference letters. These may contain additional personal data such as your date of birth or address.
Only authorised HR staff and the managers and employees involved in the application process have access to your data.
As a rule, your data is stored exclusively for the purpose of filling the vacancy for which you have applied.
Your data will be stored for a period of 6 months after the application process has been concluded. This is done to fulfil legal requirements and/or to defend ourselves against any claims arising from legal provisions, in particular under the Austrian Equal Treatment Act. After this period, your data will be deleted or anonymised. In case of anonymisation, the data will only be available to us as so-called metadata without any direct personal reference, for statistical analysis (e.g. share of female and male applicants, number of applications per period).
Talent Pool
If we would like to consider your application for future vacancies, we will only store your data in our Talent Pool with your express and separate consent (Art. 6 (1) (a) GDPR) for 24 months after the application process has been concluded. This also applies, for example, to applications for internships. You are under no obligation to give this consent, and it has no influence on your current application. You can withdraw your consent at any time with effect for the future by e-mail to info@arivo.co.
Should you be offered and accept a position with us during the application process, we will store the personal data collected as part of the application process in your personnel file for at least the duration of your employment.
Disclosure of data to third parties
Data transmitted as part of your application is transferred using TLS encryption and stored in a database. This database is operated by Personio SE & Co. KG, which offers a human resources and applicant management software solution (https://www.personio.com/legal-notice/). In this context, Personio is our processor under Art. 28 GDPR, based on a data processing agreement between us as the controller and Personio. Data is not disclosed to any other third parties unless we are legally obliged to do so or you have expressly consented.
Rights of data subjects
If we process your personal data, you have certain rights under Chapter III of the GDPR, depending on the legal basis and the purpose of the processing, in particular the right of access (Art. 15 GDPR), rectification (Art. 16 GDPR), erasure (Art. 17 GDPR), restriction of processing (Art. 18 GDPR) and data portability (Art. 20 GDPR), as well as the right to object (Art. 21 GDPR). If your personal data is processed on the basis of your consent, you have the right to withdraw this consent at any time under Art. 7 (3) GDPR.
To exercise your rights, please contact our data protection contact (see above). You also have the right to lodge a complaint with the Austrian Data Protection Authority (https://dsb.gv.at).
Concluding provisions
We reserve the right to adjust this data privacy statement at any time to ensure that it is in line with current legal requirements, or to accommodate changes in the application process or other processes. In this case, the new data privacy statement applies to any later visit to this recruitment website or any later job application.
